What types of injury claims do you handle?

While some injuries heal with proper care, many injuries cause chronic pain. Some injuries are permanent and some prevent victims from living normal lives.

At Philbrook Law, we represent personal injury victims who have all types of injuries including:

  • Traumatic brain injury (TBI). If the head of a driver or a passenger strikes a dashboard, hits another object or person, or moves back and forth quickly; a traumatic brain injury can occur. A TBI can cause loss of cognitive function, physical pain, and emotional harm.
  • Spinal cord damage. Spinal cord injuries can cause paralysis, nerve damage, and herniated discs. Victims may live with a lifetime of pain.
  • Burn injuries. Severe burns can require skin grafts and plastic surgery. For many victims, the psychological trauma of the scarring and disfigurement is just as traumatic as the physical pain.
  • Broken bones. Vehicle accidents, falls, and defective products can cause simple, compound, complex, and multiple fractures. Some fractures can heal with proper alignment and treatment. Some broken bone injuries cause permanent pain and prevent a victim from working again.
  • Other injuries. We handle all other serious injuries including organ damage, nerve damage, soft tissue injuries, muscle pain, hearing loss, vision loss, internal bleeding, burns, and crush injuries.

Who is responsible for my personal injuries?

At Philbrook Law, we file claims against every person and business responsible for your injuries. Our Portland personal injury lawyers file claims against the following:

  • Trucking companies
  • Property owners
  • Manufacturers of defective products
  • Construction sites, general contractors, and subcontractors
  • Sellers of alcohol (such as taverns and hotels) and social hosts to anyone who is visibly intoxicated and later causes an accident due to their intoxication
  • The Oregon Department of Transportation and other government agencies
  • Anyone else responsible for your personal injuries or the death of a loved one

How do you fight for personal injury victims in Portland, OR?

At Philbrook Law, we generally handle your case in the following stages:

  • The initial investigation. This investigation includes sending investigators to the scene of your accident, speaking with the police, talking to building code and fire officials, working with traffic reconstruction experts, and talking to product safety experts – depending on how your accident happened.
  • The discovery phase. We take great pride in understanding how to formally question every witness and every defendant in writing and in person. We help you answer the questions the lawyers for the defendants will ask. We also use the discovery phase to determine what insurance coverage each defendant has and whether phone records might indicate a driver was distracted, a truck driver was tired, or a property owner had prior knowledge of dangerous conditions.
  • The medical phase. We work with your doctors, and our own network of doctors when necessary, to verify your injuries, show what medical care you need, the cost of all your medical care, what complications might arise, your pain and suffering, and every way your life is difficult because of your injuries.
  • The negotiation phase. When we’re clear about how the accident happened, who is responsible, and what injuries you have; we negotiate with the insurance carriers for each defendant to try to settle your case. Many cases do settle, especially if your claim is worth more than the policy limits.

How much is my Portland personal injury claim worth?

Anyone injured due to the fault of others has the right to be placed in as close to the same position as they were before the accident. At Philbrook Law office, we demand that those people and businesses responsible for your injuries pay for your current and future:

  • Medical bills
  • Income losses
  • Pain and suffering
  • Property damage
  • Scarring and disfigurement
  • Loss of bodily function
  • Loss of quality of life
  • Loss of consortium

In unconscionable cases such as when a drunk driver causes an accident, we seek punitive damages.

If your family member died due to the fault of others, we file a wrongful death claim on behalf of the family members. Wrongful death damages include the funeral and burial costs, the loss of financial support, and the loss of the personal support and guidance your loved one would have provided.

In cases where the defendant’s conduct was wanton or malicious, we seek punitive damages. If a loved one was killed due to the negligence or fault of another, we seek wrongful death damages on behalf of the family beneficiaries, which may include funeral and burial costs.

When do I need to file my personal injury claim in Oregon?

Generally, you have to file your claim within two years from the date of the accident. In some cases, such as if you have a claim against the Oregon Department of Transportation or you have a dram shop act claim against a seller of alcohol, the time to provide notice and file your claim is much shorter.

We recommend that you contact us as soon as possible so we can start the investigation and review the medical care you need.
